Terms of use

This text is pending legal review before the app launches. Questions: [email protected].

Last updated [date]. These terms are an agreement between you and Post Nights LLC ("we"), which makes and publishes Daytoward: Post Nights LLC, 5900 Balcones Dr, Ste 5374, Austin, TX 78731, United States, +1 (512) 955-2518. Questions: [email protected].

1. What Daytoward is

Daytoward helps you plan small steps toward goals you choose, in two-week experiments that fit the hours and money you say you have. It suggests routes, steps, books, videos, podcasts, communities and events, and it can use AI to help word and shape them.

Daytoward is not professional advice. It does not give medical, legal, financial, tax or career advice, and it never promises income, a job, health results or any other outcome. Fitness steps are general and gentle; if you have a health condition, or are unsure whether exercise is safe for you, ask a doctor first (the app suggests the PAR-Q+ questions for this). You decide what to do and you are responsible for what you do.

2. Who can use it

You need to be 13 or over. If you are under 18, you need a parent's or guardian's permission to use Daytoward and to subscribe to Plus. Daytoward is offered in the United States, in English and Spanish.

3. Your account

You can use Daytoward without an account; your plan then stays on your phone. With an account (sign in with Apple, Google or a 6-digit code sent to your email) your plan syncs between your devices. Keep access to your email and sign-in methods safe. You can delete your account at any time in Settings; this deletes your plan from our servers at once.

4. Free and Daytoward Plus

The whole first chapter, with the AI coach, is free. After it you can keep going for free in one area with reviewed routes and built-in tips.

Daytoward Plus adds the AI coach after the first chapter, up to three areas at once, more routes and routes of your own, insights in the weekly review, and memory across chapters. It costs $12.99 a month or $79.99 a year in the US (the price shown in your store when you subscribe applies), with a 7-day free trial for new subscribers.

Making a step smaller is always free.

5. What you write

Your vision, notes and plans are yours. You give us only the permission needed to store them, sync them to your devices, and, when you ask for it, send the needed text to our AI provider to answer your request (see the privacy policy). We do not use what you write for advertising and do not sell it.

6. AI help

Some suggestions and wording are made by an AI model. They can be wrong or not right for you. Read them as ideas, not facts, and check anything important. Every plan the AI suggests is checked by the app against the hours and money you set, but you stay in charge of what you take on. A letter from your future self is imagined from what you wrote and the steps you took: it is not a prediction or a promise about what will happen.

7. Links, picks and events

Picks and events link to other websites and apps (for example Open Library, YouTube, podcasts, community sites and event pages). We review them before they are added and check the links every week, but we do not control those sites, their content, prices or availability. Their own terms apply.

8. Buddies and supporter links

You can invite one buddy to cheer you on, and share a read-only supporter link with a mentor.

9. Acceptable use

Do not misuse Daytoward: no attempts to break into accounts or the service, to read other people's data, to overload the service or the AI, to resell it, or to use it for anything unlawful.

10. Changes and availability

We improve Daytoward over time and may change or remove features. We will tell you in the app before a change that affects your subscription or how your data is used. We try to keep the service running but cannot promise it will always be available or error-free; your plan stays on your phone even when our servers are unreachable.

11. Ending

You can stop using Daytoward and delete your account at any time. We may suspend or end access for serious or repeated breaches of these terms, after telling you why where we can.

12. Liability

Daytoward is provided as is and as available. To the fullest extent the law allows, we disclaim all warranties not expressly stated here, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, that reminders will always arrive on time or at all, that a suggested route, step or pick will suit you, or that any outside link, event or price is still current.

To the fullest extent the law allows, Post Nights LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or losses arising from a decision you made with the app's help, a missed reminder, or something you did on another website or at an event the app suggested.

Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose, or US$50 if you paid us nothing. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Some places do not allow certain exclusions, so parts of this section may not apply to you, and you may have rights under your local consumer law that these terms cannot take away.

13. Law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, and the courts of Travis County, Texas have jurisdiction. If you are a consumer living elsewhere, this does not take away the protection of the mandatory consumer law where you live, or your right to bring a claim there.

14. App stores

These terms are between you and Post Nights LLC, not with Apple or Google. Neither store is responsible for the app or for supporting it. Where a store's own end-user licence terms apply to your download (for the App Store, Apple's Licensed Application EULA), and they conflict with these terms on a point that store requires, that store's terms govern on that point.
